    Question on family adoptions

    Hi,
    There is a situation in our family where the mother is in jail and the dad might be found unfit to have custody of the 3 month old child. There is a hearing coming up soon that will determine if the father can get the child. If he doesn't, she will be put up for adoption. My husband and I are considering adopting her if the father doesn't get custody. We have no idea what the outcome will be in the trial, nor do we know how to go about pursuing adopting her if the father doesn't get her. If it is a family adoption, what are the legalities? Right now, she is in foster care, which we hate to see that when she could be with us. Does anyone know where we should start or should we wait and see if the father gets custody before trying anything? Thank you so much.

    Becca, Have you or any family member been in touch with the foster care social worker? Do they know there are family members who can take custody of the baby or do kinship care? You need to let them know now,,,,,,,don't wait to see what the court hearing out come is.
    If mom and dad are not married, dad will probably have to prove paternity.
